1. Scope & agreement

These Terms & Conditions ("Terms") govern your use of the services provided by Mountain Peak Painters, LLC ("we", "us", "our"), an Idaho-licensed painting contractor (RCE #1881408). By requesting a quote, accepting a quote, signing a contract, paying an invoice, or receiving text messages from us, you ("Customer", "you") agree to these Terms.

These Terms work alongside our Privacy Policy and any signed contract or accepted quote specific to your project. If there's a conflict between this page and a signed contract, the signed contract controls.

2. Painting services

We provide residential and commercial painting services in the Treasure Valley region of Idaho, including but not limited to: exterior repaints, interior repaints, new-construction work, cabinet refinishing, deck staining, and commercial repaints. The exact scope, materials, and price for your project are described in the quote you accept.

3. Quotes, acceptance & deposits

Quotes are valid for thirty (30) days from the date of issuance unless otherwise stated. A quote becomes a binding contract once you:

Most projects require a deposit (typically 25% of the total) before scheduling. The deposit reserves your spot on our schedule and secures materials. Once paid, the balance is due upon job completion unless otherwise agreed in writing.

4. Payment terms

We accept payment by credit card, ACH bank transfer, or check. Online payments are processed securely by Stripe. Standard payment terms are:

Returned checks or failed ACH payments are subject to a $35 processing fee.

5. Workmanship warranty

We stand behind our work with a workmanship warranty as stated in your accepted quote (typically 1 to 7 years depending on project tier). The warranty covers defects in our application — peeling, flaking, blistering, or premature paint failure caused by our workmanship. It does not cover:

6. Change orders

If you request changes to the scope of work after a quote is accepted, those changes will be priced and approved in writing before any additional work begins. Verbal change requests will be documented and confirmed via email or text before invoicing.

7. SMS / text messaging terms

By providing your mobile phone number to Mountain Peak Painters — through our website's quote request form, by verbally confirming with a member of our team, or by replying to one of our text messages — you consent to receive SMS text messages from us related to your painting project and our business relationship with you.

We do not send promotional or marketing SMS messages without explicit additional consent.

Message frequency

Message frequency varies based on your project stage. During an active project you may receive several messages per week. Between projects, you may receive none. We do not send a fixed number per month.

Cost

Message and data rates may apply depending on your mobile carrier and plan. Mountain Peak Painters does not charge for SMS messages, but standard rates from your carrier may apply.

To opt out Reply STOP to any text message you receive from us. You'll receive one final confirmation message that you've been unsubscribed, and we will not send any further SMS messages to that number. You can opt back in at any time by texting START or contacting us directly.

Supported carriers

We send SMS messages through Twilio. Carriers supported include AT&T, T-Mobile, Verizon, Sprint, US Cellular, Boost Mobile, MetroPCS, Cricket Wireless, Virgin Mobile, and most regional and MVNO carriers in the United States. Carriers are not liable for delayed or undelivered messages.

Privacy

Your phone number and SMS opt-in information are governed by our Privacy Policy. We do not share mobile information with third parties or affiliates for marketing or promotional purposes.

8. Liability & insurance

Mountain Peak Painters carries general liability insurance ($1,000,000 occurrence / $2,000,000 aggregate) and is bonded as required by Idaho law. We're not liable for:

Our total liability for any claim related to a project will not exceed the amount paid by the customer for that project.

9. Cancellation

You may cancel a project before work begins by contacting us. Deposits are refundable in full if cancellation occurs more than 7 days before the scheduled start date. If cancellation occurs within 7 days of the start date, we may retain a portion of the deposit to cover materials ordered and crew scheduling costs.

We reserve the right to cancel a project for reasons including non-payment, unsafe site conditions, or customer behavior that prevents work from proceeding. In such cases, you'll be invoiced only for work completed.

10. Disputes & governing law

These Terms are governed by the laws of the State of Idaho. Any disputes will be resolved in the state or federal courts located in Ada County, Idaho. Before filing a lawsuit, both parties agree to make a good-faith effort to resolve the dispute by direct communication.
